In a recent case (Todd t/a Hygia Professional Training v Cutter) the employee was awarded compensation in an unfair dismissal claim for being fired when it was alleged he had poached customers to start up a rival firm.

The employer failed to provide the necessary evidence at the tribunal hearing and was not allowed to bring it forward when the case was appealed.
