There are strict time limits to start a claim in the Employment Tribunal.

In a recent case, however (TGWU v Safeway), which related to a TUPE situation where a depot closed leading to redundancies, the union initially laid claims to unfair dismissal but subsequently wanted to include further claims under different legislation.

The Employment Tribunal allowed the additions even though they were out of time, on the basis that the same facts gave rise to the new ‘offences’.
