In a recent case (Royal Bank of Scotland v Bevan) it was held that where an employer concluded an internal appeal against an employees’ dismissal just five hours before the normal three month Employment Tribunal limit, then the tribunal hearing should be extended from three to six months.

However, the extension is only to be applied if the employee reasonably believed the disciplinary procedure is still ongoing when the three months expires.
