In a recent case South London and Maudsley NHS Trust v Dathi, Mrs Dathi claimed discrimination because

(a) The employer refused to disclose certain documents

(b) She received a strong letter resisting her application for costs

The appeal tribunal decided both letters attracted absolute immunity and even if they did not they would be considered honest and reasonable communication between representatives for the purpose of preparing for trial and hence a defence to a victimisation claim.
